Answer: بِسْمِ اللهِ الرَّحْمنِ الرَّحِيْم In the name of Allah, the Most Gracious, the Most Merciful Assalamu ‘alaykum wa rahmatullahi wa barakatuhu, If a halal mortgage provider stipulates in the purchase agreement that, if a client repays more than 10% above the yearly repayment amount, they must pay an “early repayment fee,” then such a fee is not jaa’iz. One is still permitted to repay early despite the fee being stipulated, and the stipulation itself is deemed null and batil. Imposing a fee solely due to early repayment amounts to a financial penalty for a lawful act. Such a condition is neither valid nor enforceable in Shariah. In fact, it is oppressive. The Prophet ﷺ said: لاَ ضَرَرَ وَلاَ ضِرَارَ “There should be neither harm nor reciprocating harm.”–Sunan Ibn Majah, Hadith #2341. And he ﷺ also said: وَالْمُسْلِمُونَ عَلَى شُرُوطِهِمْ إِلاَّ شَرْطًا حَرَّمَ حَلاَلاً أَوْ أَحَلَّ حَرَامًا “The Muslims are bound by their conditions, except a condition that makes the lawful unlawful or the unlawful lawful.”—Sunan al-Tirmidhi, Hadith #1352 Hence, considering the above, one is permitted to repay early without an amount restriction, and a penalty fee for excessive repayment is not jaa’iz. I learned that women can’t travel past 48 miles without a mahram. But in today’s time, I see a lot of women regularly travel long distances for school, work, and leisure, like for example, commuting to Rutgers or to work sometimes over an hour each way every day.Would this kind of regular commuting still fall under the same ruling as سفر (long-distance travel), or is it treated differently? Are those women considered sinful?

I suffered from an illness related to a coccyx (pilonidal) cyst. There were discharges from my coccyx that would soil my underwear. At home, I would put on a dressing with someone else’s help, but when I was in the city and alone there, and I needed to use the bathroom, I had to remove the dressing. I could not put on a new one by myself.What should I have done to prevent blood or pus from getting onto my underwear? Does a sanitary pad or a dressing attached to the underwear that contains impurity (najāsah) serve as a barrier for prayer, and is it considered part of the clothing? If yes, what should I do regarding the impurity getting onto my underwear, as I could not protect myself from it?

It is a common type of cyst located in the crease of the buttocks—anywhere from the tailbone to the anus—and is usually caused by a skin infection. This would have served as a barrier preventing blood or pus from getting onto your underwear and soiling it as a result. During this illness, if the cyst continued bleeding or discharging pus such that no prayer time remained free from impurity, then wudhu would have been required only once at the beginning of each prayer time. In such a case, the sanitary pad would not have acted as a barrier affecting the validity of the prayer, though a new one should have been applied before performing each wudhu. Please could you answer this as Ramadan is in 1 day and I don’t know if this will break my fasts. Sometimes when I wake up, I’m unsure if I had a wet dream and so I gently squeeze my private part to check whether any liquid comes out. This is not done with any intention of sexual stimulation, and I do not feel any desire or pleasure when doing it. I am only trying to confirm whether discharge occurred during sleep. Sometimes my suspicions are correct and a white liquid comes out although, I can’t tell if it’s maniy or madhy but as per the Hanafi fiqh, any presence of liquid requires ghus Does the mere act of squeezing to check for discharge without pleasure invalidate the fast?

Accordingly, they are as follows: 1. Does squeezing the private part to check for discharge—without any intention of pleasure—invalidate the fast? Squeezing one’s private part to check for either discharge (madhiy) or sperm (maniy)—without any intention of pleasure—does not invalidate the fast. That which breaks the fast due to exiting from the private parts is the following: 1. Sperm that exits due to lust. 2. Sperm that exits due to masturbation. 3. Sperm that exits due to sexual intercourse.[1] That said, one should not squeeze their private part to check whether any liquid has come out simply due to being unsure as to whether they had a wet dream or not. Furthermore, such an action should not be made into a habit, as it can lead to OCD. Rather, a person should only check for wetness—whether on their body or their clothing—in the case where they recall having had a wet dream. 2. If a discharge such as madhiy gets onto bedsheets and then dries quickly without leaving any visible trace, do the bedsheets need to be washed, or can one continue to use them? If any sort of impurity gets onto one’s bedsheet and shortly dries up thereafter, it would, in principle, be permissible to continue using such a bedsheet for sleeping. Ideally, however, the bedsheet should be washed as soon as possible, and one should sleep on a pure bedsheet instead.[2] 3. If madhiy gets onto clothing (e.g., pyjamas) and dries without leaving a visible stain or moisture, is it permissible to wear them again for sleeping (while not praying in them)? The above scenario shares the same answer as found in question #2. Does any madhab allow jama baynas salatayn due to cold?

The Hanafi madhhab does not permit combining prayers (الجمع بين الصلاتين) due to any weather conditions. If a young married couple are already living separately (with their respective families) though the marriage has been consummated, would the wife be entitled to Nafaqah in case of divorce? The fiqh books say that if she is a Nashizah and leaves her husbands house بغير حق then she doesn’t deserve Nafaqah- but in this case they never lived together in the first place?

This allows for the growth and fostering of the marriage. However, if for whatever reason, husband and wife willingly choose to live separate from one another, then this will be permissible. In such a case, a husband must still provide for the wife.[1] Accordingly, in a situation where a woman is already living separately with her parents, and a divorce then occurs, she remains entitled to nafaqah from her ex-husband during the ‘iddah period. Nafaqah from her ex-husband will not cease in her case as her parents’ home has always been her original place of stay during the marriage. If a musaafir performed 4 instead 2,he has to repeat No if a local guy prayed behind him will he have to repeat as well because of the imams salah? it correct?
Answer: بِسْمِ اللهِ الرَّحْمنِ الرَّحِيْم In the name of Allah, the Most Gracious, the Most Merciful Assalamu ‘alaykum wa rahmatullahi wa barakatuhu, In the Hanafi madhhab, a musafir must pray two raka’at in place of every four raka’at fardh salah.[1] A musafir must repeat his salah in the following scenario: If he unintentionally performed four raka’at instead of two, and did not perform sajdah al-sahw—which is an expiation for his mistake—he must repeat the prayer if the time for that prayer has not elapsed. If, however, he completed his salah without performing sajdah al-sahw, and the time for that salah ended, then he does not have to repeat his salah and it is considered valid If a muqeem (local/resident) prayed 4 raka’at behind a musafir Imam, then he will not have to repeat his salah if the Imam realizes his mistake after the time of that prayer has elapsed. Salam mufti saab big question After reading on this Would it make trading through this broker halal? Reason to ask is I’ve heard forex is haram however certain brokers work their way round to ensure its shariah compliant? Is this true or are these ‘named’ halal?

Be that as it may, Forex trading, based on the mainstream model, is impermissible due to elements of interest (riba), excessive uncertainty (gharar), and lack of proper ownership. According to IFG (Islamic Finance Guru) there is no such thing as ‘Islamic Forex Trading’. It is a marketing tactic with no real substance. Forex Trading in a nutshell is the trading of currencies that one does not own. The currencies are derivates which do not exist as the exchange rate of the currencies is not derived from any data, and hence, in essence, is not actual money. Moreover, the ‘money’ in Forex Trading is leveraged. Leveraging is where money is borrowed to trade bigger multiples on the money that you ‘own’. This is a problematic issue as it begs the question as to where the money is coming from. Either the money is a derivative and doesn’t exist, or it is a loan along with added amounts (fees, etc.)—both of which are impermissible.
